Gifting (Endowment) Registration Transaction

 

Documents required

  1. Original property title deed.
  2. Original gift contract.
  3. Copy of valid passport (for non- Bahraini).

Fees

  • Gift between spouses and relatives to the fourth degree.
  • 5 BD fixed fees for every transaction.
  • 1 BD  land registration form costs for every transaction.

 

  • Property value is 50,000 BD or less (Gift not between spouses or relatives).
  • 5 BD fixed fees for every transaction.
  • 1 BD  land registration form costs for every transaction.

 

  • Property value is more than 50,000 BD (Gift not between spouses or relatives).

 

 

  • 2% of property value.

 

 

Registration Obstacles:

  • A court reservation letter regarding the property from the courts under the Ministry of Justice and Islamic Affairs indicating non-disposition of the property (placing an encumbrance), which is annotated in the records of the Survey and Land Registration Bureau.
  • Annotation in the register of a lawsuit related to real rights on the property.
  • Submission of a donation (gift) issued by the Sharia Court after one year has passed.
  • Issuance of a decision by the Minister of Works, Municipalities Affairs and Agriculture prior to property ownership registration.
  • Existence of a mortgage.
  • Submission of the notarized contract after one year from its notarization.

 

Notes:

  • Copies of the aforementioned documents and requirements must be submitted when applying for electronic registration.
  • Donations (gift contracts) are not accepted if more than one year has passed since their conclusion, unless renewed by the competent court.
