We, Hamad bin Isa Al Khalifa, the King of the Kingdom of Bahrain,

Having reviewed the constitution,

And Amiri Order No. (4) of 1975

 And Legislative Decree No. 8 of 1970 with respect to Lands Acquired for Public benefit, as amended,

 And the Land Registration Law promulgated by Legislative Decree No.(15) of 1979,

And Legislative Decree No.(8) of 1987 governing the Ownership of Storeys and Flats ,

And Legislative Decree No. (11) of 1995 with respect to the Protection of Antiquities,

And Legislative Decree No. 28 for 1999 governing the Establishment and Organization of Industrial Areas

And Legislative Decree No. 40 of 1999 with respect to the Land and property Ownership by GCC nationals in the Kingdom of Bahrain

And upon the submission of the Minister of Justice and Islamic Affairs,

And having sought the opinion of the Shura Council

And after the approval of the Council of Ministers,

Hereby Decree the Following:

Article 1

Without prejudice to the rights of GCC countries’ citizens to own lands and properties, non-Bahrainis, whether natural persons or legal entities, may own lands and properties in the Kingdom of Bahrain by any acts of disposal as prescribed by law or heritage in areas, and according to conditions, which shall be promulgated by an order issued by the Council of Ministers in this respect.

Article 2

Commercial, industrial and Tourism Companies and other Banking and Financial institutions, which are fully owned by Bahrainis and licensed to practice business in the Kingdom of Bahrain, may own lands properties for the purposes of establishing economic projects in their licensed business lines according to the following conditions:

1. The purpose of establishing a company or enterprise in the Kingdom of Bahrain shall be to establish a commercial, industrial, financial, tourism, heath, educational or training institution or to make Bahrain the main centre to invest their capitals in activities related to the distribution of goods or services offered by such companies or any other investment or economical projects or any other activities which shall be promulgated by an order t be issued by the Council of Ministers.

2. The property shall be allocated in areas as specified by an edict to be issued by the Council of Ministers with respect to governing licensed activities.

 3. The property area shall be appropriate to accommodate the  intended activity in accordance to organizing regulations specified by the concerned authority.

Article 3

Every act of disposal which violates the provisions of this Law shall be deemed as nullified, unlawful, and repealed.

Article 4

The Council of Ministers shall issue the executive orders for implementing this law.

Article 5

The ministers, each in his respective capacity, shall implement the provisions of this Law, which shall come into effect from the date of its publication in the Official Gazette.
