Legislative Decree No. (40) of 1999 regarding the Ownership by GCC Nationals of Built Properties and Lands in the State of Bahrain

 

 

We, Hamad bin Isa Al Khalifa Emir of the State of Bahrain. 

Having reviewed the Constitution; 

Emiri Order No. (4) of 1975, 

Proclamation No. 3 of 1968 regarding the Ownership of Nationals of the Kingdom of Saudi Arabia. 

Proclamation No. 12 of 1968 regarding the Ownership of Nationals of the State of Kuwait. 

Land Registration Law promulgated by Legislative Decree No. 15 of 1979, 

Legislative Decree No. 1 of 1995 regulating the appropriation of lands and buildings in Bahrain by citizens of the States of the Gulf Cooperation Council for the Arab States of the Gulf. 

And Legislative Decree No. 9 of 1997 concerning the appropriation of land and buildings by citizens of the United Arab Emirates. 

Upon the submission of the Minister for Justice and Islamic Affairs; 

And after the approval of the Council of Ministers, 

Hereby Decree the following Law: 

Article One 

Without prejudice to the right of the citizens of the Arabian Gulf Cooperation Council countries to own built properties and lands, non-Bahrainis, whether natural persons or body corporate, may own constructed properties and lands in the State of Bahrain by using one of the legally prescribed methods of disposal or by way of inheritance. 

Article Two 

Each conveyance or disposal issued in contravention of the provisions of this Law shall be null and void, and shall have no legal effects, and may not be registered. 

Article Three 

The Ministers - each within his jurisdiction- shall implement this Law, and it shall come into force upon its publication in the Official Gazette.
